Just a query - when developing games or apps that use mp3s for music/sound do we need to obtain some kind of licence?

I vaguely remember comments elsewhere that usage of mp3 files requires some kind of licence for commercial use or similar?

Reason I ask is that not all formats support .ogg which I'm fairly sure doesn't have this issue - but is this still the case/or was it ever the case (mp3s and licensing)?

The license is required for mp3 codec, but iPhone, Android, Flash, XNA and HTML5 targets do not require you to distribute any codec (it's already built in in the target) so I do not think you need any license.

I'm not sure about the GLFW target tho.

You do need a license, but only for distribution of games that sell less than 5000 copies:

However, it doesn't say how this applies to web games, which could easily go over this amount.

I'd imagine one of these would apply, and it does allow for non-commercial use, but I imagine if you added adverts to the page it's hosted on, that would change things...

... no license is needed for private, non-commercial activities (e.g., home-entertainment, receiving broadcasts and creating a personal music library), not generating revenue or other consideration of any kind or for entities with associated annual gross revenue less than US$ 100 000.00



Make of that what you will! I'd re-encode to .ogg and/or .wav myself...
